Abstract

The implementation of the departure of prospective Umrah pilgrims is carried out by the Umrah pilgrimage organizing bureau with prospective Umrah pilgrims using an agreement. As is known, Book III of the Civil Code adheres to an open ideology or because the parties are free to determine the contents of the agreement and will submit to the legal system regarding the matter being agreed, however, this principle of freedom must not conflict with norms and laws, thereby negating the principle of honesty, appropriateness, justice and legal certainty. The type of research used is normative juridical research, library research with the problem approach used in writing this thesis is the statutory approach. The research results show that basically, according to the Civil Code (KUHPdt), liability in the field of civil law can arise due to breach of contract and due to unlawful acts (onrech matigedaad). Default occurs if the Umrah travel agency does not carry out its obligations, namely not providing performance as agreed and the legal consequences that occur due to the failure of prospective Umrah pilgrims to depart as a result of the Umrah travel agency, namely the Umrah travel agency violating Article 65 paragraph 1 of the Government Regulation of the Republic of Indonesia Number 79 of 2012 concerning the Implementation of Law Number 13 of 2018 concerning the Implementation of the Hajj Pilgrimage, regulates prohibitions on organizers of Umrah pilgrimages
